Abstract

This article compares Brazilian and North American jurisprudence regarding the right to health, demonstrating the different constitutional rules and perspectives adopted by the Judiciary in both countries. In the Brazilian case, the article discusses legal substantialism and relativism, the existential minimum and the reserve of the possible, micro and macro justice, and the theories of utopia and the costs of rights. It concludes with a discussion of the application of the principle of separation of powers in both Brazil and the United States.
