The text concerns the topic of the legal possibility of the ex-
istence and validity of the Moderating Power or moderating function and the hypothesis of attributing such competence and exercise to the Armed Forces, under the terms of CF/88. In the development of the article, it was decided to address historical-constitutional and infraconstitutional aspects regarding the theme.
