Desafios e perspectivas para a prova dos crimes de redução a condição análoga à de escravo (art. 149 do Código Penal)

This paper aims to outline perspectives for evidence gathering and production in criminal proceedings related to the crime of modern slavery (article 149 of the Brazilian Penal Code). Based on data examined in a 2020 study by the Modern Slavery and Human Trafficking Clinic at UFMG, it exposes issues that impact the conviction rate for this type of offense, as well as relevant issues involving aspects of memory and eyewitness testimony psychology. Finally, practical perspectives are presented for seeking an improvement in the quality of evidence production, which may eventually be subjected to further studies to examine their potential practical outcomes.
